Details of the Geographical Indications Regulations for the Protection of National Products

The Board of Directors of the Saudi Authority for Intellectual Property approved the implementing regulations for the Geographical Indications Protection Law, a strategic step aimed at establishing a comprehensive legal framework. The Geographical Indications Regulations to protect products associated with their geographical regions, preserve their brand identity, and enhance their economic value both domestically and internationally, thereby supporting the competitiveness of national products and solidifying the Kingdom's position within the intellectual property rights protection system.

The roots and development of interest in intellectual property

Historically, the concept of protecting products from their geographical regions has been linked to long-standing international agreements such as the Paris Convention for the Protection of Industrial Property and the TRIPS Agreement. In Saudi Arabia, this focus on the region is the culmination of a long process of developing legislative and commercial systems in line with international standards. A pressing need arose for specialized legislation to prevent the exploitation of the names of Saudi regions renowned for specific products, such as "Al-Ahsa Dates," "Taif Roses," or "Bin Khawlan," on counterfeit products unrelated to the region. This necessitated the establishment of a firm regulatory framework to safeguard rights and prevent infringement upon the Kingdom's agricultural and industrial heritage.

Economic dimensions of implementing the Geographical Indications Regulation

The implementation of the Geographical Indications Regulation has a significant impact across multiple levels. Locally, this regulation supports farmers, artisans, and local producers, ensuring fair economic returns and protecting their efforts from unfair competition. Regionally and internationally, this measure enhances the credibility of Saudi exports in global markets and opens new horizons for international trade. Officially registered geographical indications serve as a mark of quality and a guarantee for foreign consumers, increasing the export value of national products and supporting the goals of Saudi Vision 2030 to diversify non-oil revenue sources.

Who is eligible to apply for registration?

The regulations specify the categories eligible to apply for geographical indication registration. This right is granted to legal entities representing producers of products related to the relevant geographical area, as well as to competent national or international bodies seeking recognition of geographical indications within their jurisdiction. This approach reflects the Authority's commitment to enabling both production and regulatory bodies to benefit from the system, thereby granting local products official legal recognition.

Comprehensive national registry and strict requirements

The regulations stipulate the establishment of a special register in which all applications for registration of national and foreign geographical indications are recorded, including the names of applicants, descriptions of the indications, associated products, and usage guidelines. The regulations also grant the Authority the power to amend or delete any data that has been included unlawfully. Furthermore, they establish precise acceptance requirements, most notably that the indication must be linked to natural or human factors (such as environmental or climatic characteristics or traditional skills), and must not be merely a common, generic designation. It must also be visually or semantically distinctive to prevent consumer deception.

User Guide: The Essential Document

The regulations devote considerable space to the so-called “User Manual,” which is the essential document in the registration file. The manual must include the product name, a description of its characteristics, its connection to the geographical region, production methods, and the components involved. It must also specify the officially recognized geographical region, explain the impact of natural and climatic factors on the product, and describe the packaging method. The authority is responsible for verifying that the manual meets all requirements, and may enlist the assistance of governmental or private entities for review.

Extensions for examination, publication, and objection procedures

The regulations stipulate a period not exceeding 180 days for reviewing registration applications after the required documents are submitted, extendable for a similar period. If the conditions are met, the application is officially published to allow any interested party 30 days to submit appeals. The relevant committee is obligated to review the appeals and issue its decision within 60 days, while granting those affected the right to appeal to the competent court.

Exceptional powers for the CEO

The regulations grant the CEO of the Authority exceptional power to issue a decision to register the national geographical indication even in the absence of a prior registration application, or if its protection period has expired and has not been renewed, provided that non-registration could harm the Kingdom's international reputation, affect the competitiveness of national products, or serve the public interest. This provision is a proactive tool for protecting strategic products.

Control and renewal of protection

The regulations clarified the registration renewal process, specifying that renewal must occur within the final year of the protection period or within one year of its expiry, and warned that protection would automatically lapse upon delay. They also included detailed provisions outlining the mechanisms for addressing violations through the Authority's inspectors, who handle complaints and reports within 90 days, ensuring strict and effective enforcement of the system to protect both markets and consumers.
