A fine of 1600 riyals for violators of vehicle routing applications in Saudi Arabia

The Public Transport Authority in Saudi Arabia announced a comprehensive set of regulatory amendments targeting the executive regulations for passenger transport brokerage activities. This decisive step aims to regulate the operation of ride-hailing applications, with the Authority imposing fines of up to 1,600 Saudi Riyals on companies employing unlicensed drivers. This decision primarily aims to enhance governance and mandate official driving permits, directly contributing to improved service quality and ensuring the highest standards of safety and security for all passengers across the Kingdom.

The smart transportation sector in the Kingdom has developed

The past few years have witnessed a qualitative leap in the transportation sector within the Kingdom, as traditional services have shifted entirely to reliance on technology. Technology has played a pivotal role in facilitating the movement of citizens and residents. Historically, the regulation of this sector has been gradual, aligning with the objectives of Saudi Vision 2030, which focuses on localizing jobs and providing flexible employment opportunities for Saudi youth. With the massive expansion in the use of digital platforms, it has become essential to continuously update legislation to address any regulatory gaps that could negatively impact user experience or compromise public safety. Recent amendments have included updating the definition of the Authority's electronic platform, making it the official and sole source for accessing data on establishments, vehicles, and drivers, as well as granting the necessary permits for operating private vehicles.

Legal working conditions in vehicle routing applications

To ensure the provision of a professional service, the updated regulations define a 'permit' as the official approval issued by the Public Transport Authority, which qualifies a driver to work legally in ride-hailing applications. This procedure is considered a fundamental pillar for practicing the profession legally and correctly. The Authority has restricted drivers' work by requiring them to obtain this prior permit, setting three essential conditions: the driver must be a Saudi citizen, must possess a valid driver's license, and, most importantly, must have a clean criminal record. The amendments emphasize that these conditions are essential for the permit's validity, and it will be automatically and immediately revoked if any of them are violated, to guarantee continued efficiency and reliability.

Strict penalties to ensure service quality

The authority has mandated that service providers contract only with licensed drivers, emphasizing that the contract period must not exceed the validity period of the establishment's business license. In a decisive move, operating companies must immediately cease working with any driver whose license is revoked. To enforce this oversight, the updated regulations impose graduated financial penalties, starting with a fine of 300 riyals for non-compliance with the service provision policy. The penalty escalates to include license suspension for periods ranging from three to nine months. Furthermore, the authority has increased the deterrent penalty to a fine of 1,600 riyals for the first offense of failing to cease working with a driver whose license has been revoked, in addition to implementing corrective measures such as warnings or suspensions.

Economic and security dimensions of the new organizations

The significance of these decisions extends beyond mere regulation, encompassing far-reaching positive impacts. Domestically, these amendments ensure the protection of users' rights and create a safe and reliable transportation environment, thereby bolstering public trust in digital services. They also safeguard the rights of compliant Saudi drivers from unfair competition. Regionally and internationally, the Kingdom sets a leading example in the governance of the 'sharing economy' and the freelance sector. By strengthening digital oversight across the Authority's platforms, Saudi Arabia aligns with global best practices in managing the smart transportation sector, positioning the Saudi transportation market as one of the most regulated, secure, and attractive for technology investments in the Middle East.
