New Saudi Explosives Regulations: Licensing Requirements and Hajj Guidelines

In a move aimed at strengthening the security system and modernizing legislation related to hazardous materials, the Saudi Ministry of Interior has published the draft executive regulations for the Explosives and Fireworks Law on the "Istilaa" platform. This initiative is part of the Kingdom's ongoing efforts to regulate the manufacturing, import, and handling of these sensitive materials, ensuring the highest standards of public safety and national security.

A regulatory framework that aligns with Vision 2030

This regulation is of particular importance given the major urban and industrial development underway in Saudi Arabia as part of Vision 2030. With the expansion of mining projects, road construction, and mega-projects like NEOM and the Red Sea Project, the need for civilian explosives for industrial purposes is increasing. Therefore, this regulation establishes a strict legal framework that balances meeting the needs of economic development with maintaining security and stability, preventing any loopholes that could lead to the misuse of these materials.

Strict financial and administrative requirements for manufacturers

The regulations set precise standards for establishing explosives manufacturing companies, stipulating the requirement to provide an unconditional bank guarantee of one million Saudi riyals in favor of the Ministry of Interior, valid for five years. They also stipulated that the company director must be a Saudi national with no criminal record or security restrictions, reflecting the legislator's commitment to Saudization of sensitive positions in this sector and ensuring the security reliability of those working within it.

Tight security measures during the Hajj season

Given the unique nature of the Hajj season and the importance of securing the holy sites, the regulations included a strict time-bound ban on import and export operations. Specifically, the articles prohibited the import or export of explosives during the period from the 30th of Dhu al-Qi'dah to the 20th of Dhu al-Hijjah each year. This measure is part of the precautionary security measures the Kingdom takes annually to ensure the safety of pilgrims to the Holy Mosque and to allow security forces to focus on serving the guests of God.

Import regulations and technical specifications for warehouses

The regulations did not overlook the precise technical aspects, specifying categories of companies permitted to import, such as companies licensed to explore for oil and gas and drill deep wells, with a requirement for a bank guarantee of 200,000 riyals for imports. Regarding storage, the regulations imposed strict engineering and geographical requirements, including:

• The warehouses must be located at least 10 kilometers away from urban areas.
• Provide two paved access routes to the site, at least one of which must be asphalt.
• The warehouses are equipped with lightning arresters, CCTV surveillance systems, and protective earthen fences.
• The construction of warehouses is prohibited in floodplains or royal reserves.

The implementation of this regulation is expected to enhance the efficiency of the mining and construction sector by legally and transparently organizing the supply chains for explosives.
